1. Agreement to Terms
These Terms of Service govern access to and use of Wavechrome Film Portal. By creating an account, accessing, or using the service, you agree to be bound by these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.
2. Nature of the Service
Wavechrome Film Portal is a quality assurance, record-keeping, and data management platform intended for use by qualified professionals, including medical physics and radiotherapy quality assurance teams. It is designed to organize film inventory, measurements, calibration records, and related operational data.
Wavechrome Film Portal is not intended to replace professional judgment, independent verification, institutional procedures, or any required clinical review process. All clinical decisions, treatment decisions, patient-specific interpretations, and regulatory determinations remain solely with the licensed professional or healthcare organization using the service.
3. No Medical Device Claim
Wavechrome Film Portal is not a medical device and is not represented as cleared, approved, or certified by any regulatory authority, including the FDA, CE marking authorities, or similar bodies, unless explicitly stated otherwise in a separate signed written agreement. The service is provided as a software platform for data management and workflow support.
You are solely responsible for determining whether and how the service may be used within your jurisdiction, institution, quality system, and regulatory framework.
4. User Accounts and Access Control
You must provide accurate registration information and maintain it in current form. You are responsible for safeguarding credentials, restricting account access appropriately within your organization, and ensuring that user permissions are assigned and reviewed in accordance with your internal policies.
5. Customer Responsibilities
You are responsible for:
- verifying the accuracy, completeness, and suitability of data entered into the service;
- reviewing outputs, measurements, labels, exports, and records before relying on them for operational or clinical purposes;
- maintaining appropriate institutional procedures, approvals, validation steps, and independent checks;
- ensuring compliance with applicable laws, regulations, and policies, including privacy, security, retention, and healthcare-specific obligations such as GDPR, HIPAA, or similar frameworks where applicable.
6. Availability, Security, and No Warranty
We will use commercially reasonable efforts to operate the service reliably and securely. Our availability commitments, support response targets, and data recovery objectives are described in the Service Level Agreement (SLA). However, the service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.
7. Data Retention and Backup
We may maintain reasonable backup and recovery procedures, but we do not guarantee against data loss, corruption, deletion, or unavailability. You are responsible for maintaining your own backup copies or exported copies of any critical records, reports, calibration data, or other information that you may need for operational, legal, regulatory, or clinical purposes.
8. Limitation of Liability
To the maximum extent permitted by law, Wavechrome Film Portal and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill, data, clinical outcomes, patient outcomes, institutional findings, or regulatory penalties arising out of or related to the use of, or inability to use, the service.
Without limiting the foregoing, we are not responsible for clinical interpretation of measurements, treatment planning decisions, machine QA conclusions, patient-specific decisions, or your organization's compliance with any professional, regulatory, or accreditation requirement.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service or these Terms of Service will not exceed the fees paid by the customer for the service during the twelve (12) months immediately preceding the event giving rise to the claim.
9. Suspension and Termination
We may suspend or terminate access to the service if you violate these Terms of Service, create a security risk, misuse the platform, or if continued service would expose us or other users to material risk.
10. Changes to the Terms
We may update these Terms of Service from time to time. Continued use of the service after a new version becomes effective may require renewed acceptance. The current version identifier is 2026-03-30.
